These Terms and Conditions ("Terms") govern your use of theeliteengines.com, our member dashboard, software engines, training materials, and related services (collectively, the "Service"), operated by The Elite Engines ("we", "us", "our"). By creating an account, purchasing a product, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

1. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account or purchase from the Service. By using the Service, you represent that you meet this requirement and that any information you provide is accurate and current.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that are inactive for extended periods.

3. License to Use the Service

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

You may not: (a) resell, sublicense, or redistribute access to the Service; (b) reverse engineer, decompile, or attempt to extract source code; (c) use the Service to build a competing product; (d) remove or obscure any proprietary notices.

4. Subscriptions, Credits & Billing

Some features of the Service are offered on a subscription basis or a credit-based model. By subscribing, you authorize us (and our payment processors) to charge the applicable fees to your payment method on a recurring basis until you cancel.

• Recurring billing: Subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal.
• Credits: Credits granted through plans, refills, or promotional offers are valid only while your account is active. Unused credits may expire on plan downgrade or account closure.
• Price changes: We may change pricing for new billing cycles with reasonable advance notice. Existing subscribers will be notified before any change takes effect.
• Taxes: Prices are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes.

5. Refund Policy

We offer a 30-day money-back guarantee on initial purchases of digital products and subscriptions, unless explicitly stated otherwise on the product sales page. To request a refund, email support@theeliteengines.com from the email address used at purchase, within 30 days of the original transaction.

The following are not eligible for refunds:

• Renewal charges on subscriptions where the subscription was not cancelled before renewal.
• Credit refill packs after credits have been consumed.
• Purchases made in violation of these Terms or where abuse is detected.
• Done-for-you services after work has begun.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right;
• Send unsolicited bulk email (spam) or commercial messages without proper consent;
• Generate, distribute, or store unlawful, defamatory, harassing, or sexually explicit content involving minors;
• Attempt to gain unauthorized access to any system, account, or data;
• Introduce malware, conduct denial-of-service attacks, or interfere with the Service;
• Scrape, crawl, or extract data from the Service in bulk without our written permission;
• Misrepresent affiliation with any person, brand, or organization.

Violation of this section may result in immediate suspension or termination without refund.

7. Intellectual Property

All content, software, designs, trademarks, logos, training materials, and other materials made available through the Service ("Our Content") are owned by The Elite Engines or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Except for the limited license granted in Section 3, no rights are transferred to you. You may not reproduce, republish, or distribute Our Content without our prior written consent.

8. User Content & AI-Generated Output

You retain ownership of content you upload, input, or otherwise provide to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free license to host, process, and display it solely to operate and improve the Service.

For content generated using our AI engines based on your inputs ("AI Output"):

• You may use AI Output for your personal or business purposes, including commercial use, subject to these Terms.
• AI Output is provided "as is" and may resemble or coincide with content generated for other users. You are responsible for reviewing AI Output for accuracy, originality, and legal compliance before publishing or relying on it.
• You must not publish AI Output that infringes third-party rights, deceives consumers, or violates any law.

9. Third-Party Services

The Service integrates with third-party providers (including but not limited to payment processors, email senders, cloud hosting, and AI model providers). Your use of those services is subject to their own terms. We are not responsible for the acts, omissions, or content of any third party.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

We make no guarantees regarding any income, results, leads, traffic, conversions, or business outcomes you may achieve from using the Service. See our Earnings Disclaimer for details.

11. Limitation of Liability

To the fullest extent permitted by law, in no event shall The Elite Engines, its affiliates, officers, employees, or partners be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Service.

Our total cumulative liability for any claim arising under these Terms shall not exceed the amount you paid to us during the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Elite Engines and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use or misuse of the Service, (b) your violation of these Terms, (c) Your Content, or (d) your violation of any third-party right.

13. Termination

You may cancel your subscription or close your account at any time from your dashboard or by contacting support. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Service or other users. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and indemnification) will survive.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts located in Bengaluru, Karnataka, India, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. If we make material changes, we will notify you by email or through a prominent notice on the Service before they take effect. Continued use of the Service after changes constitutes acceptance.
