DMCA Compliance & Takedown Policy

The Elite Engines respects the intellectual property rights of others and expects users of our Service to do the same. This page describes the procedure for submitting a notice of copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA) and analogous procedures available under other applicable copyright regimes.

1. Reporting Copyright Infringement

If you are a copyright owner (or authorised to act on behalf of one) and you believe that material accessible through theeliteengines.com infringes your copyright, you may submit a written notice of infringement to our designated agent. To be effective, your notice must include all of the elements listed in Section 2.

2. Required Elements of a Valid DMCA Notice

Pursuant to 17 U.S.C. § 512(c)(3), your notice must contain substantially the following:

1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
3. Identification of the material that is claimed to be infringing — with sufficient detail (such as a direct URL) to permit us to locate it;
4. Reasonably sufficient contact information for the complaining party — including name, mailing address, telephone number, and email address;
5. A statement that the complaining party has a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law;
6. A statement, made under penalty of perjury, that the information in the notification is accurate and that the complaining party is the copyright owner or is authorised to act on its behalf.

Notices that fail to comply with these requirements may not receive a response.

3. Designated Agent for Notices

Email is the preferred method of submission for fastest review.

4. What Happens After You File a Notice

1. We review your notice for completeness.
2. If the notice is valid, we will promptly remove or disable access to the material identified, and notify the user who posted it.
3. The user will have an opportunity to submit a counter-notice (see Section 5).
4. Repeat infringers will have their accounts terminated under our policy described in Section 6.

5. Counter-Notice

If you believe material you posted was removed or disabled in error or as a result of misidentification, you may submit a counter-notice. To be valid, your counter-notice must contain substantially the following, pursuant to 17 U.S.C. § 512(g)(3):

1. Your physical or electronic signature;
2. Identification of the material that has been removed and the location at which it appeared before removal;
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification;
4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if you reside outside the United States, any judicial district in which The Elite Engines may be found), and that you will accept service of process from the person who provided the original notification or their agent.

Submit counter-notices to the email above with the subject "DMCA Counter-Notice".

6. Repeat Infringer Policy

It is our policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. We may also, in our sole discretion, limit access to our Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents in a notification or counter-notification that material is infringing or was removed by mistake may be liable for damages, including costs and attorneys' fees. We will report such misrepresentations to the appropriate authorities and may pursue remedies available to us.

8. Other Jurisdictions

If you are reporting infringement under copyright laws other than the DMCA (for example, the EU Copyright Directive or India's Information Technology Act, 2000 with applicable IT Rules), please send the equivalent of a notice to the email above with details of the applicable law and the specific elements that law requires.
